    Jury Selection: Essential Strategies & Tactics

    This presentation will provide a trial consultant’s perspective on how to maximize success in jury selection. Specifically, the following will be addressed in detail: 1) problems with conventional wisdom; 2) best practices, including which goals to prioritize and how to tailor language to achieve them; 3) the role of background research, including social media; 4) the impact of COVID-19.  

    Stephen Duffy is a Vice President and Senior Consultant at Trial Behavior Consulting. He works on a wide variety of civil cases, including product liability, premises liability, personal injury, toxic torts, employment, commercial, and medical malpractice, as well as white collar criminal cases. He provides the full range of trial consulting services, including jury selection assistance, pretrial research, witness preparation, trial strategy consultation, post-trial interviews, and change of venue research. Stephen has conducted pre-trial research in hundreds of cases across more than 35 states and selects a dozen-plus juries a year across the country. He excels at adapting quantitative learnings to the courtroom and is particularly adept at creating customized jury selection models. Stephen has presented on a variety of topics, including deposition preparation, jury selection strategy and tactics, and trial strategy fundamentals.  Stephen has a pair of degrees in political science:  a B.A. from the University of California, Santa Barbara and a M.A. degree from California State University. Fullerton.

    Prior to joining Trial Behavior, Stephen worked for a boutique communications firm specializing in litigation and political research. While there he moderated dozens of focus groups and implemented and analyzed numerous public opinion surveys at the national, statewide, and local level.

    Daren Casagrande, LMFT, will be presenting: Maintaining Professional Efficacy and Mental Wellness During COVID, Economic Hardship, and Political Contention.

    Daren, founded Clarity Counseling after spending over 10 years working in mental health organizations and experiencing many issues related to mental health disorders. He will bring his experience and expertise to our field with this topic which is extremely relevant right now. Mr. Casagrande emphasizes that, “we’re all wearing a little thin right now. This historical moment in our country has added stress and mental load to our daily living - often eating through our margin and exposing the cracks in our mental health and wellness. Maybe we're drinking or smoking just a little more. Maybe we're seeing increased irritability or decreased motivation. Maybe we're having a hard time even concentrating and our mind keeps wandering off in the middle of something important. These are just some of the signs that the cracks could be showing. So how can we make sure that we're serving the clients we have left ethically and with professionalism in the midst of all this?     Alcoholism, Addiction Mental Health and Stress In the Era of Covid-19 and the Impact on the Legal Profession

    Legendary trial attorney Gary Gwilliam has been speaking to lawyers on this topic for many years.  One of his talks is entitled "Am I Drinking Too Much is a Rhetorical Question." In this time of shelter-in-place with many law offices operating remotely, it's time to address how substance abuse impacts the legal practitioner and discuss both old and new ways to avoid excesses and find new ways to navigate these troubled waters.  His associate Jayme Walker joins him in this presentation.

    Jayme Walker is a trial attorney with Gwilliam Ivary Chiosso Cavallli & Brewer focusing on civil rights, employment, personal injury and wrongful death cases.  She has been recognized by the Recorder for Top 10 Leading Plaintiffs Bay Area Employment Law and California Super Lawyers as a Rising Star every year since 2014. She is currently President Elect of the Alameda Contra Costa County Trial Lawyers Association.

    The Bench Conduct and Demeanor Training will be held at the Dietrich Theatre on the Sierra College Campus beginning at 2:30pm on September 30.  This training session will give you the requisite 3 hours required every 3 years in order to keep current.  Presenters for this session will be the Hon. Eugene Gini, Hon. Suzanne Gazzaniga, Hon. Michael Jones and Hon. Glenn Holley, Commissioner.

    California State Public Plans – CalPERS and CalSTRS

    Whether a CalPERS member or the ex-spouse, there will be basic questions on how to divide the largest public retirement plan in California.  We will discuss what to watch out for during the case with an active member vs. a retired member, how estimates on which way to divide may be helpful, how to handle disability, and the biggest pitfalls with a CalPERS division.

    • Issue Spotting;
    • Disability; and
    • Drafting judgment language for defined benefit pension plans.
