Jury Selection: Essential Strategies & Tactics

This presentation will provide a trial consultant’s perspective on how to maximize success in jury selection. Specifically, the following will be addressed in detail: 1) problems with conventional wisdom; 2) best practices, including which goals to prioritize and how to tailor language to achieve them; 3) the role of background research, including social media; 4) the impact of COVID-19.  

Stephen Duffy is a Vice President and Senior Consultant at Trial Behavior Consulting. He works on a wide variety of civil cases, including product liability, premises liability, personal injury, toxic torts, employment, commercial, and medical malpractice, as well as white collar criminal cases. He provides the full range of trial consulting services, including jury selection assistance, pretrial research, witness preparation, trial strategy consultation, post-trial interviews, and change of venue research. Stephen has conducted pre-trial research in hundreds of cases across more than 35 states and selects a dozen-plus juries a year across the country. He excels at adapting quantitative learnings to the courtroom and is particularly adept at creating customized jury selection models. Stephen has presented on a variety of topics, including deposition preparation, jury selection strategy and tactics, and trial strategy fundamentals.  Stephen has a pair of degrees in political science:  a B.A. from the University of California, Santa Barbara and a M.A. degree from California State University. Fullerton.

Prior to joining Trial Behavior, Stephen worked for a boutique communications firm specializing in litigation and political research. While there he moderated dozens of focus groups and implemented and analyzed numerous public opinion surveys at the national, statewide, and local level.
