Speakers: David Gaw

David Gaw, well known leader in trust administration processes and law in California, will discuss:

  • Use of checklists, spreadsheets, and diagrams
  • Examples of administration, using stock and real estate as assets
  • Asset allocation, division between individuals and trusts, and property tax issues
  • Income tax issues including IRC 654 election, fiscal year end, DNI, and the “65 day rule” (IRC 663(b))
  • Effects of section 16061.7 notice
  • Why draft credit trusts, and effects on filing 706, Q-Tipping?, and “Delaware Tax Trap”
  • Filing 706 for portability?  Why?  And when?
  • “Informal” accounting vs. “formal” accounting either court or non-court

Prior to the publication of Mr. Gaw's below publications, there was no written or acknowledged process for the administration of a living trust on the death of a single person, on the death of the first Spouse to die, or on the death of the Surviving Spouse.  Mr. Gaw created a comprehensive system for administering a trust which included standard forms and processes.  This system continues to be widely used by estate planning lawyers and paralegals throughout California.

Mr. Gaw is a Certified Specialist in Estate Planning, Trust and Probate Law, designated by the State Bar of California and is a Fellow of the American College of Trusts and Estate Counsel (ACTEC).  He began his practice in Napa in 1972, and co-founded Gaw Van Male in 1975.  In 2018, he began Gaw Estate Planning which is exclusively dedicated to trust administration and estate planning.

This lunch presentation will be held at Cante Ao Vinho and gourmet lunch boxes from Nugget Market will be provide which will include: Sandwich, seasonal salad, chips, cookie and an apple.  Bottled water will be provided.  Feel free to bring your own drink if you prefer something other than bottled water.  Vegetarian and Gluten Free options available.

Due to logistics in providing lunch, registration will close on April 25, 2023.  Be sure to sign up as soon as possible.  Space is limited to 30 attendees!

This presentation will provide one hour MCLE credit or one hour specialty credit.

Cost is $30 for PCBA PEP section members and $35 for PCBA non-section members or non PCBA members. Space is limited so be sure to sign-up early.
